Condo buildings

Condo boards: approval before work on common elements

In an Ontario condo, windows and balcony doors are often common elements. Changing them generally needs board approval first, recorded under section 98 of the Condominium Act in an agreement registered on title. The declaration decides who owns what, so if you rent out a suite, check with management before booking more than a like-for-like repair.

Rental licensing: why window condition matters

Hamilton now permanently licenses rental buildings of five or fewer units in Wards 1, 8 and parts of Ward 14. The program grew out of complaints about property standards and absentee landlords, among others. Check your address on the City's rental housing licence page; we don't map streets to wards.

A building's worth of glass is quoted as a list. What moves it:

  • Number of units, and how many visits it takes
  • What each item is: screen, rollers, sealed unit or pane
  • Sizes and glass types, since sealed units are made to order
  • Access: occupied suites, keys, elevators, balconies
  • Frame and track condition

Some Lower City rentals sit in a heritage district or are designated. There, replacing windows or doors, removable storms included, needs a Heritage Permit first; fixing a broken pane usually doesn't. A smashed sash pane can go ahead; a window swap waits. See the heritage district guide.
